Basement Apartments for Utah County Homeowners

Millgate Homes builds basement apartments in Utah County for two very different kinds of homeowners: people who want rental income from a basement they’re not using, and people who want a real, self-contained space for a parent, adult child, or other family member. Both start the same way — a legal basement apartment needs a bedroom with an egress window, a bathroom, some form of kitchen or kitchenette, and usually a separate entrance — but which city you’re in changes the permitting path more than almost any other basement project we build.

As of 2025, Utah state law (HB 82, now Utah Code § 10-9a-530) requires cities to allow an internal basement apartment as a permitted use in most residential zones — meaning a qualifying basement apartment generally doesn’t need a discretionary public hearing the way it once might have. Cities still set their own rules on owner-occupancy, parking, and registration, though, and those rules genuinely differ across American Fork, Lehi, Saratoga Springs, and Eagle Mountain:

  • Lehi requires the homeowner to occupy the primary home, with a recorded Declaration of Owner Occupancy filed with Utah County, one dedicated off-street parking space, a minimum 6,000-square-foot lot, and only one ADU per parcel.
  • Saratoga Springs zones every property as IADU Approved, Potential, or Prohibited — in a Potential or Prohibited zone, the surrounding subdivision has to petition the city for reclassification before an apartment can be permitted at all. Approved properties need a building permit plus a separate IADU registration form, a dedicated 9’x18’ paved parking space, and owner-occupancy of either unit.
  • Eagle Mountain requires two off-street parking spaces (more than most Utah County cities ask for), a 36-inch-wide unobstructed path from the apartment’s exit to the street, and restricts ADUs to true single-family homes — not townhomes or multi-family properties. Eagle Mountain’s growth from roughly 250 residents to more than 76,000 in three decades means a lot of newer single-family homes are exactly the kind of property this applies to.
  • American Fork’s basement/accessory apartment rules are on file with the city’s building department — we’ll confirm the current owner-occupancy and parking requirements with them directly as part of your free consultation, since we want you working from the current version, not an assumption.

 

None of that is legal advice, and city ordinances change — Millgate pulls the building permit and handles every construction inspection, and we’ll walk you through what your specific city requires before you commit to a design, but the owner-occupancy declaration or IADU registration paperwork itself is typically something you file with the city directly.

  • 2×4 walls, 16” on-center, treated floor plates, LVL headers at openings
  • R-19 exterior wall insulation; R-13 interior wall insulation in the bathroom (free upgrade — most builders skip this)
  • ½” drywall, hand-textured to match your upstairs finish

Our Basement Apartment Process

Step 1 — Free Consultation

We walk your basement, talk through whether you’re building for a renter or a family member, and flag what your specific city will require.

Step 2 — Design & Estimate

Our in-house design team lays out the bedroom, bathroom, kitchen/kitchenette, and entrance, sized to meet egress and your city’s ADU requirements, with a clear estimate based on that plan.

Step 3 — Permitting & Scheduling

Millgate pulls the building permit and schedules the project. You’ll separately handle any owner-occupancy declaration or ADU registration your city requires — we’ll tell you exactly what that is.

Step 4 — Framing & Rough-Ins

Framing, plumbing rough-in, and electrical rough-in, followed by the city’s rough-in inspection.

Step 5 — Insulation, Drywall & Finish Carpentry

Walls insulated, drywall hung and textured, trim installed.

Step 6 — Fixtures, Kitchen/Bath & Finish Work

Tub/shower, tile, cabinetry, countertops, fixtures, and paint.

Step 7 — Final Walkthrough, Inspection & Warranty

 Final city inspection, walkthrough with you, and your 2-year builder’s warranty starts that day.

Timeline: A basement apartment is typically the most extensive room-type we build, since it combines a bedroom, bathroom, kitchen or kitchenette, and often a new entrance. What Does a Basement Apartment Cost?

A basement apartment is the most extensive basement project Millgate builds, because it stacks a bedroom, a full bathroom, and a kitchen or kitchenette into one project — each of those adds its own plumbing, electrical, and finish costs.

As a real reference point: a recent 1,040-square-foot Saratoga Springs basement finish with bedrooms and a full bathroom (no kitchen) came to $48,300. Adding a full kitchen package — cabinetry, countertop, sink, and full appliance circuits — runs an additional $24,470 based on that same project’s documented pricing. A kitchenette instead of a full kitchen costs meaningfully less than that (see our Kitchenettes page).

What actually moves the number for a basement apartment:

Functionally, yes — “mother-in-law apartment” is just the family-use version of the same basement apartment build. The construction is identical; the difference is who lives there. A lot of Utah County homeowners in fast-growing family cities like these four are building exactly this kind of space for an aging parent or adult child rather than a renter.
Do I need to live in my home to rent out a basement apartment? +
It depends on your city. Lehi and Saratoga Springs both currently require the homeowner to occupy either the main home or the apartment (with some exceptions). Eagle Mountain’s published ADU checklist doesn’t list an owner-occupancy requirement. Confirm current rules with your city before finalizing plans — they do change.
